The present document is aimed at the regulation of the GENERAL TERMS AND CONDITIONS OF HIRING the on-line reservation services offered by Variante 2000, S.L whose registered address is C/ Ramn y Cajal, 41 31360 Funes (Navarre), VAT number B31652142, (hereinafter HOTEL PEÑALEN) registered in the Companies House of Navarre, Volume 658, Folio 171, Sheet NA-13.648. Telephone 948716100. The use of these services will suppose their full acceptance (with no exceptions) and the validity of all the General Terms and Conditions which will be automatically considered as included in the contract subscribed with HOTEL PEÑALEN. No written transcription is required because these are gathered in the last updated version of these General Terms and Conditions.

Use of the on-line reservation services offered by Hostel Peñalen

On-line reservation services

1. On-line reservation services are aimed at the reservation of a room in HOTEL PEÑALEN. The use of these services will suppose their full acceptance (with no exceptions) and the validity of all the General Terms and Conditions which will be automatically considered as included in the contract subscribed with Hostel Peñalen. No written copy will be necessary as these general terms and conditions are gathered in the last updated version of these General Terms and Conditions.
2. Hiring procedures: when processing the on-line reservation, the user will receive a confirmation mail in which a locator code will be provided for each reservation. This mail will serve as a receipt of your reservation and will have to be shown when checking into the hostel.
3. Guarantee: The reservation of a whole night will be confirmed and guaranteed by means of a credit card. In the event that, without previous notice, a guest does not show up in the hostel, the quantity established within the cancellation terms will be charged.
4. Cancellation of the Reservation: any cancellation of the reservation made in advance will not imply any additional cost if made three days previous to the arrival date and must be communicated to the hostel by e-mail. Once this delay is exceeded, Hostel Peñalen will charge the corresponding cancellation costs as compensation which will amount to 30% of the reservation cost.
   This clause will not be valid for reservations made within more than a month in advance. In this case, the guest should advise the hostel by e-mail ten days in advance to the arrival for this cancellation not to generate any additional cost. If the guest fails to do so, Hostel Peñalen will charge a fee equivalent to 30% of the reservation cost.
   The time limit for the arrival of any guest into the Hostel is 20:00 h of the day of arrival. Once this limit is exceeded, and if no previous notice has been given to the hostel, Hostel Peñalen can cancel this reservation and as a compensation, a quantity equal to the total amount of the reservation cost can be charged to the user. In the case that the user had requested any extra service (such as the entry tickets to Senda Viva Park), the cancellation of the reservation will not exempt him from the total payment of the extra service requested.
5. Prices for room and night. Prices are only valid when written and just for the season they apply to. If justifiable reasons arise, HOTEL PEÑALEN will have the right to modify hostel rates without previous notice. Prices concerning the reservation will be communicated during the reservation process. VAT in force will be applied to all prices
   All prices include bedroom and breakfast.
   Discounts on offers valid at the time of on-line reservation will be directly applied at the reception of Hostel Peñalen when making effective the payment of the invoice for the nights of the stay or other costs incurred when staying in the hostel. For this purpose, you will have to show the receipt of the on-line reservation (received mail) where the offers applicable at the moment of the reservation appear.
   The customer cannot take advantage of two different offers at a time. The higher discount will be always applicable.

Duties of users
Users commit themselves to using services in accordance to the law, morality, good manners and public order and respecting the General Terms and Conditions. As a consequence, he is bond not to use services with illicit aims or those contrary to what is established in the current General Terms and Conditions of the service hired or any other aim which may harm the rights and/or interests of third parties or which may harm the services offered by Hostel Peñalen or its image.

Protection by Hostel Peñalen of users' personal data

The user of on-line reservation services offered by www.hostelpealen.com is voluntarily providing data of personal nature (hereinafter personal data) and is expressly accepting, with no exceptions, the automated usage of these data to be included in a file kept by HOTEL PEÑALEN with the only aim at the offer of services. Hostel Peñalen is responsible for this file and for its registration before the relevant authority.

The owner of the data will always have the right to access this file and make any rectification, cancellation or opposition as stated in the provisions of the law of protection of personal data. In the same way, the consent of the user for the treatment and transfer of his personal data will be revocable at any time without retroactive effects in accordance to the provisions of sections 6 and 11 of Organic Law 15/1999 of 13 December on the Protection of Personal Data.

HOTEL PEÑALEN guarantees that the appropriate measures regarding security in its facilities, systems and files are observed. In the same way, HOTEL PEÑALEN assures the confidentiality of the Personal Data, although personal data and any other information within its power or accessible within its systems, that may be requested according to the legal provisions applicable, can be revealed to the relevant authorities. In any case, users of www.hostalpenalen.com shall guarantee and be held responsible for the truthfulness, accurateness, validity and authenticity of the personal data provided and shall commit themselves to keep them duly updated.

Services offered by HOTEL PEÑALEN are not aimed at people under 18 and HOTEL PEÑALEN does not gather or ask for any information concerning this age group.

Right of modification

HOTEL PEÑALEN reserves the right to make, without previous notice, any modification considered appropriate in its web site, being able to change, suppress or add any content or service provided in it as well as the format in which information is introduced or located in the site. The same applies to the General Terms and Conditions of the hiring and use of services.

Guarantee and responsibility exclusion

Hostel Peñalen does not guarantee the reliability, availability or continuity of the services available to users, and excludes any responsibility on harms and damages of any nature that may be derived from the lack of availability, reliability or continuity of the present web site or of the services provided in it. In any case, Hostel Peñalen will try to provide, as far as possible, technical support to any person who may be affected.

IN THE EVENT THAT HOTEL PEÑALEN, DESPITE ACTING WITH THE DUE PRECAUTION AND CONSCIENTIOUSNESS AND, FOR ANY REASON NOT ATTRIBUTABLE TO HOTEL PEÑALEN ITSELF, IS NOT ABLE TO PROVIDE A ROOM THAT HAS BEEN PREVIOUSLY BOOKED, AND IF NO POSSIBILITY OF PROVIDING THE SERVICES IN THE AGREED TERMS OCCUR, HOTEL PEÑALEN WILL OFFER THE USER THE POSSIBILITY OF CHOOSING BETWEEN THE TOTAL REFUND OF THE AMOUNT ALREADY PAID OR THE SUBSTITUTION OF THIS SERVICE FOR A SIMILAR SERVICE IN TERMS OF CATEGORY OR QUALITY. IF THE SUBSTITUTION OF THE SERVICE HAPPENS TO BE ONE OF A LOWER CATEGORY OR QUALITY, HOTEL PEÑALEN SHALL REFUND THE DIFFERENCE.

Hostel Peñalen is not forced to control and, therefore, does not control in advance the absence of viruses or any other harmful elements within the contents of the present web site which may alter the software or hardware of users visiting it. For this reason, Hostel Peñalen shall not be held responsible for any harm or damage of any kind which may derive from them.

Safeguard of the General Terms and Conditions of Hiring Services by Hostel Peñalen

If one of the statements gathered in the present General Terms and Conditions of hiring services by Hostel Peñalen is declared null or inoperable, the rest of the General Terms and Conditions will be kept in the agreed terms. HOTEL PEÑALEN commits to substitute the statement affected by nullity by another statement which resembles as much as possible to what was first intended.

IN NO WAY, A STATEMENT IN THIS CONTRACT WILL AFFECT TO THE PROVISIONS COMPULSORY FOR CONSUMERS. IF YOU ARE NOT A CONSUMER, YOU EXPRESSLY RENOUNCE TO YOUR RIGHT OF ABANDONMENT OF ACTION.

Hostel Peñalen web site and the acceptance of usage regulations

The user is aware that the use of the on-line reservation services will imply the full acceptance, with no exceptions, of each of the clauses forming the following usage regulations of www.hostalpenalen.com as in the version published by HOTEL PEÑALEN in the moment in which the user is hiring the service. For this reason, the user should be considered aware of the importance of consulting the regulations of the present web side, before entering it and/or hiring services.

Applicable Law and Jurisdiction

The present terms and conditions are ruled by Spanish Law. In the event of any discrepancy or dispute caused by the interpretation or application of the present terms and conditions or those related to the usage of this web site, HOTEL PEÑALEN and the user, agree, expressly waiving their own or any other venue that may correspond to them, to definitively resolve by means of Arbitration of Laws, to be held in the city of Pamplona in compliance with the Arbitration Law of 5 of December 1988.

Both parts undertake the acceptance and fulfillment of the decision taken by the arbitration, and if this decision needs to be formalized or executed by the judge, in the event that the arbitration is not put into effect by mutual agreement of the parties, or by being declared null, both parts, waiving their own venue if any, agree to abide the Courts and Tribunals legally qualified for the jurisdiction of HOTEL PEÑALEN.
